The U.S. Court of Appeals for Veterans Claims and the U.S. Court of Appeals for the Federal Circuit issue dozens of precedential decisions each year that affect hundreds of thousands of veterans, dependents of veterans, and survivors of veterans who have claims before VA regional offices and the Board of Veterans’ Appeals (BVA). Without an understanding of recent caselaw, you will be less effective in developing strategies and arguments in support of claims for VA benefits. These court decisions could provide new ways for you to help claimants establish entitlement to VA benefits, but might also invalidate arguments you’ve made for pending claims.
This webinar will highlight the most important changes in veterans law stemming from court decisions issued from January through June 2026, with a focus on how advocates can use these developments to the advantage of the claimants they represent. By the end of this webinar, you should understand:
- Whether the BVA must consider evidence a claimant submitted in an earlier appeal that was referenced by the claimant, but not actually resubmitted, during the AMA evidentiary window for the current appeal
- Whether the VA can implicitly deny a claim subject to the AMA
- Whether a veteran can receive multiple awards of SMC(k) for the loss or loss of use of more than one creative organ
- Whether a letter from the BVA advising a claimant that a Notice of Disagreement was untimely is a final decision subject to court review
- Whether a finding identified as “favorable” by a VA adjudicator is binding on subsequent VA adjudicators, if the finding is not actually advantageous to the claimant
